By installing, accessing, or using the Fayara™ software ("Software"), you ("User") agree to be bound by these Terms & Conditions ("Terms"), which incorporate our End User License Agreement (EULA) and Privacy Policy. If you do not agree, do not install or use the Software.
1. Agreement to Terms
These Terms govern your use of the Software. The Terms should be read together with our EULA and Privacy Policy.
2. License & Restrictions
- Fayara™ is proprietary software owned by Fahim Anjum.
- The current release is provided for non-commercial, personal use only. Commercial use, resale, or commercial exploitation requires prior written permission.
- You are granted a limited, non-exclusive, non-transferable, revocable license to use Fayara™ solely for personal purposes.
- You may not copy, modify, redistribute, reverse-engineer, or otherwise use the Software beyond what is expressly permitted in these Terms or the EULA.
User Obligations
- Use the Software only for lawful purposes and in accordance with these Terms.
- Maintain the security of your account and devices used to access the Software.
- Comply with all applicable laws, rules, and regulations when using the Software.
Prohibited Activities
- Reselling, sublicensing, renting, leasing, or otherwise commercially exploiting the Software without prior written permission.
- Reverse-engineering, decompiling, or attempting to derive source code except where permitted by law.
- Distributing, copying, or modifying the Software beyond what is expressly permitted.
- Using the Software in any unlawful manner or to infringe upon the rights of others.
Intellectual Property
All rights, title, and interest in and to the Software, including all intellectual property rights, are and will remain the exclusive property of the Author. No rights are granted except as expressly stated in these Terms.
Future licensing: The Author reserves the right to introduce separate licensing options in the future. If this occurs, updated terms will be published, and continued use may require acceptance of those updated terms.
3. Privacy & Data Handling
Fayara™ is designed with strong privacy principles. We do not sell your personal information or data to third parties. See our Privacy Policy for details on what we collect, how we use it, and how we protect it.
4. Termination
Fahim Anjum may suspend or terminate your license if you breach these Terms. Upon termination, you must immediately cease use and delete all copies of the Software.
5. Warranties & Liability
- The Software is provided “AS IS” without warranties of any kind, whether express or implied.
- To the maximum extent permitted by law, Fahim Anjum shall not be liable for indirect, incidental, or consequential damages arising from your use of the Software.
- In no event shall liability exceed the amount paid in the six (6) months preceding a claim.
6. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in California, and you consent to the personal jurisdiction and venue of such courts.
7. Trademarks
"Fayara™" is a trademark of Fahim Anjum. You may not use this trademark, logo, or associated branding without prior written permission. All other trademarks, product names, and company names mentioned are the property of their respective owners.
8. Entire Agreement
These Terms, together with the EULA and Privacy Policy, constitute the entire agreement between you and Fahim Anjum regarding the use of Fayara™ and supersede any prior understandings or agreements.
